1. About the Service

Tulastay is operated from India by Surya Narayan Mishra. The Service is an informational hotel price-comparison tool. Tulastay is not a travel agent, hotel or booking site, and does not sell accommodation, accept bookings or process payments.

2. Eligibility

You must be at least 18 years old, or use the Service under the supervision of a parent or guardian, and be capable of entering into a binding contract under Indian law.

3. Sample data

While partnerships are being set up, hotels, prices, photos and links shown on the Service may be sample data for demonstration only. Sample data is clearly labelled and is not a real offer.

4. Third-party bookings

The Service links to third-party websites (“Partners”). Any booking you make is made directly with the Partner and is governed by the Partner’s terms, conditions and privacy policy. Tulastay is not a party to that contract and is not responsible for bookings, payments, changes, cancellations, refunds or the services provided by Partners or hotels.

5. Prices and information

Prices, taxes, fees, availability, ratings and cancellation terms are provided by third parties and may change at any time. The final price and terms on the Partner’s website may differ from those shown on the Service. Always confirm details on the Partner’s website before booking.

6. Affiliate relationships

We may earn commissions when you click Partner links or make bookings. See our Affiliate Disclosure.

7. Accounts and communications

If we offer accounts, saved searches, price alerts or newsletters, you are responsible for keeping your login details secure and for activity under your account. You may unsubscribe from marketing emails at any time. We may suspend or terminate accounts that breach these Terms.

8. Acceptable use

You agree not to:

• scrape, crawl, harvest or copy content or data from the Service by automated means, except search engines that comply with our robots.txt;
• interfere with, overload or disrupt the Service, or attempt to gain unauthorised access to it;
• reverse engineer, frame or mirror any part of the Service;
• use the Service for any unlawful, fraudulent or misleading purpose.

9. Intellectual property

The Service, including the Tulastay name, logo, design, software and original content, is owned by or licensed to Tulastay and protected by intellectual property laws. Third-party trademarks, images and map data belong to their respective owners (see photo credits). You may not use our content except as permitted by these Terms or by law.

11. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including accuracy, completeness, availability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, Tulastay shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Service, bookings made with Partners, or reliance on information shown on the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnity

You agree to indemnify Tulastay against claims arising from your breach of these Terms or misuse of the Service.

14. Changes to the Service and Terms

We may modify or discontinue the Service at any time. We may update these Terms and will change the “Last updated” date above. Continued use of the Service after changes means you accept the updated Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts of India shall have exclusive jurisdiction over any dispute arising from these Terms or the Service.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
